Terms of Service

These Terms of Service ("Terms") govern your use of the website located at house-of-outcast.vercel.app and any successor domain (the "Site"), and your purchase of tickets, making of donations, and attendance at events, all operated by House of Outcast, an independent, unincorporated performance collective based in San Diego, California ("House of Outcast," "we," "us," or "our"). By accessing the Site, purchasing a ticket, making a donation, or attending an event, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase from us.
1. Eligibility
You must be at least 13 years old to use the Site and at least 18 years old (or the age of majority in your jurisdiction) to purchase tickets or make donations. By purchasing, you represent that you meet these requirements. Some productions contain mature themes; content advisories, where given, are informational and attendance decisions are your responsibility.
2. Tickets — All Sales Final
- No refunds. All ticket sales are final. Tickets are non-refundable and, except as described below, non-exchangeable. Please confirm the performance date and quantity before completing checkout.
- Cancellation or rescheduling. If we cancel or reschedule a performance, we will, at our sole option, offer you an exchange for another performance or a refund of the ticket price. This is your sole and exclusive remedy for a cancelled or rescheduled performance.
- Admission. Tickets are general admission. Seating is first-come, first-served. Your confirmation email and the name on your order serve as your ticket; we maintain a guest list at the door.
- Right to refuse entry. We and the venue reserve the right to refuse entry to, or remove, any person who is disruptive, intoxicated, violates venue rules, or poses a safety risk, without refund.
- Late arrival. Latecomers may be held until an appropriate break in the performance, at the discretion of house management.
- Resale. Tickets may not be resold for profit or used for promotions without our written consent.
3. Assumption of Risk at Live Events
Live theatre involves inherent risks. Productions may include strobe or flashing lights, theatrical fog or haze, loud sound, sudden effects, simulated violence, mature themes, and audience proximity to performers. By attending, you voluntarily assume all risks arising from attendance, including risks of personal injury, illness, or property damage, to the fullest extent permitted by law, and you agree to comply with all venue safety rules and staff instructions.
4. Photography & Recording
Performances may be photographed or recorded by us for archival and promotional purposes. By attending, you consent to being incidentally photographed, filmed, or recorded as a member of the audience, and to our use of such material without compensation. Unauthorized audio or video recording of performances by attendees is prohibited.
5. Donations
Donations are voluntary gifts in support of our work. House of Outcast is an independent collective and is not a registered 501(c)(3) charitable organization; donations are not tax-deductible and are non-refundable. Donations do not entitle the donor to tickets, goods, services, or any ownership or decision-making interest.
6. Payments
Payments are processed by Stripe, Inc. We do not collect or store your card details. Your payment is also subject to Stripe's terms and privacy policy. Prices are stated in U.S. dollars. Early-bird and promotional pricing is available only during the stated window and the price applied is the price in effect at the time of checkout.
7. Intellectual Property
The Site and all of its content — including production titles, scripts, performances, stage designs, logos, images, text, video, and the House of Outcast name and marks — are owned by House of Outcast or its licensors and are protected by copyright, trademark, and other laws. You are granted a limited, revocable, non-exclusive license to access the Site for personal, non-commercial use. No other rights are granted. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.
8. Acceptable Use
You agree not to:
- use the Site for any unlawful, fraudulent, or misleading purpose;
- attempt to gain unauthorized access to the Site, its servers, or related systems;
- introduce malware or interfere with the Site's availability or security;
- scrape, harvest, or bulk-collect data from the Site;
- submit false information through our forms or impersonate any person;
- infringe the intellectual property or privacy rights of others.
9. Third-Party Services
The Site may link to or rely on third-party services (including Stripe for payments, Instagram, and venue websites). We are not responsible for third-party content, services, or terms, and linking does not imply endorsement.
10. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOUSE OF OUTCAST AND ITS MEMBERS, ORGANIZERS, PERFORMERS, AND VOLUNTEERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE SITE, TICKET PURCHASES, DONATIONS, OR EVENT ATTENDANCE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50) IF YOU HAVE PAID NOTHING. NOTHING IN THESE TERMS LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
12. Indemnification
You agree to indemnify and hold harmless House of Outcast and its members, organizers, performers, and volunteers from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or your conduct at an event.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction. Either party may instead bring an individual claim in small-claims court where eligible.
14. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms. Material changes to ticket terms will not apply retroactively to tickets already purchased.
15. General
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a reorganization of the collective. Sections 3, 4, 7, and 10 through 13 survive any termination. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Site.
